Juice Quest's Terms and Conditions

General:

Squatters Catering Services Pty Limited ACN 623 268 002 trading as Juice Quest ABN 91 6232 68002 grants you a non-exclusive, limited and revocable license to use and access the website and online ordering platform (collectively known as ‘Juice Quest website’). In these Terms and Conditions, “us”, “we” and “our” refer to Juice Quest and references to “you” and “your” is to you, the end user. These Terms and Conditions are made in accordance with the laws prevalent in South Australia.

AGREEMENT BETWEEN JUICE QUEST AND YOU WHEN USING THE JUICE QUEST WEBSITE:
By accessing and using the Juice Quest website, you agree to be bound by these Terms and Conditions. If you do not agree with these Term and Conditions you must immediately stop using the Juice Quest website. We may change, update or otherwise amend the Juice Quest website at our absolute discretion and without notice.

JUICE QUEST’S GOODS AND SERVICES PROVIDED TO YOU:
Juice Quest may offer you access to goods and services for sale, or access to controlled areas of the Juice Quest website. To accept any offer made by Juice Quest and access these goods and services, you must advise Juice Quest of all information requested and register this information via the Juice Quest website.

TERMS OF SALE (any good or service offered via the Juice Quest website):
Juice Quest Online goods & services purchase terms;

  1. All prices displayed on the Juice Quest website are in AUD;
  2. Any purchase of items from the Juice Quest website (an ‘order’) is confirmed only when you complete payment for the items. Payments must be made by credit card.
  3. Juice Quest will not honour any order which has not been paid for in full.
  4. Juice Quest shall advise you of any delivery fees prior to dispatch and are therefore advertised prior to the payment of your order.
  5. You understand that online orders through Juice Quest website are subject to collection from our HQ or Home Delivery (Juice Quest HQ, 18 Vintage Road, Underdale SA 5032).
  6. HQ Pick-Up and Home Delivery is available Wednesdays, Thursdays and Fridays.
  7. All juice products are made to order. As such all orders are subject to the specific pick-up or delivery days and times listed on our shop pages and confirmed in your order invoice. Juice Quest do not take responsibility for incorrect selections made by you in the ordering process.
  8. All pick-ups must be completed before 2:30pm, Wednesday – Friday. If you are unable to arrive at Juice Quest HQ before 2:30pm, you must contact Juice Quest within 2 hours of ordering to make alternative arrangements. If you fail to contact Juice Quest within this timeframe, Juice Quest reserves the right to cancel your pick-up order with no refund.
  9. Once a pick-up date and time has been confirmed it is your responsibility to follow through with collection of the order. Pick-up address is 18 Vintage Road, Underdale SA 5032. Juice Quest will advise you of the preferred/best time for collection. 
  10. Home deliveries are available Wednesdays – Fridays. If you are unavailable to receive your order in person, please leave a cooler bag/box with ice/ice-blocks in it for us to place your order in. Juice Quest boxes are (24cm W x 11.5 cm D x 20 cm H). Your order must fit within your provided cooler bag/box with lid closed. If you do not provide a chilled cooler bag/box we reserve the right to return your order to our HQ and/or cancel your order. 
  11. It is your responsibility to make yourself available for delivery or pick-up.
  12. You agree to take the responsibility for any risk of damage or loss of your order once your order has been collected from our HQ or delivered to your home.
  13. Juice Quest is not responsible for any loss, damage, inconvenience or similar detriment as a result of incorrect instructions provided by you to Juice Quest (examples include, but are not limited to incorrect credit card details, incorrect contact information, incorrect pick-up date/time selected by you, incorrect delivery address).

Your responsibility after picking up your order or after your order has been delivered by Juice Quest;

  1. You must refrigerate all Juice Quest products. It is your responsibility to ensure that the products are refrigerated as soon as possible after pick up. Any delays in refrigeration which result in poor quality Juice Quest products will not be reimbursed by Juice Quest is any way.
  2. Juice Quest products are guaranteed fresh for 5 days after pick-up/delivery. Each bottle has a use by date printed on the bottom edge. Please refer to the use by dates for best the to consume Juice Quest products.
  3. It is your responsibility to ensure all Juice Quest products are stored correctly.

YOUR HEALTH AND MEDICAL INFORMATION WHEN ORDERING AND CONSUMING JUICE QUEST PRODUCTS:
You acknowledge and understand that Juice Quest products have not been pasteurised. The effect of not being pasteurised means that each Juice Quest product is raw and shall be treated as such. Raw products are not recommended for pregnant or breastfeeding women, those with a weakened immune system, young children, those on certain medications and anyone generally concerned about the consumption of raw produce. If you fall within one of these categories, Juice Quest advises you to contact a medical professional before consumption of any Juice Quest product. Juice Quest, its members, employees and representatives do not give medical advice or specific health related advice. Any recommendations given by any Juice Quest team member shall be treated as general advice only and shall not supersede advice given by any trained medical professional.

Juice Quest do not make any health claims about our products. Although we may share outcomes experienced by previous customers that are known benefits of some of the ingredients we use; you accept that you may not experience these benefits.

You must consult a medical professional before consuming Juice Quest products if you suffer from allergic reactions which may result in anaphylaxis (or similar), are diabetic/insulin dependent, take prescription medication or follow dietary guidelines set by a medical professional. It is your responsibility to inform us if you suffer any of these conditions before you place an order;

  1. Juice Quest products are advertised to be gluten free. Our products are made in a wheat free environment, however, we can not guarantee that any of our products are celiac safe;
  2. Juice Quest products are advertised to be dairy free. We do not use any dairy in the production of our juice. 
  3. Juice Quest products are advertised to be vegan. We do not use any animal products in the production of our juice. 
  4. Some Juice Quest products are nut free. We use specialty equipment, seperate from our other juice production, for making our Almond nut milk. We take cross contamination and nut allergies very seriously. We have taken every precaution to contain nuts (almonds) to one machine. However, we can not 100% guarantee trace elements within our other products because nuts are handled within our facility. It is your responsibility to take this information into account and make an informed discussion as to whether you consume our products knowing the above mentioned. 
  5. Juice Quest takes no responsibility for any allergic reaction as a result from consuming our products. 
  6. Juice Quest products contain a range of high quality organic and non-organic ingredients. Juice Quest do not claim to be certified organic.

The statements made on this website or in any email your receive from Juice Quest have not been evaluated by the Therapeutic Goods Association (TGA). The products sold on this website and/or information you read within emails and marketing material (including but not limited to information on our social pages) are not intended to diagnose, treat, cure, or prevent any disease. The information provided by this website or this company is not a substitute for a face-to-face consultation with your physician, and should not be construed as individual medical advice. Consumer reviews, testimonials and opinions are based on the experiences of individual Juice Quest Raw Cold Pressed Juice consumers. Juice Quest Raw Cold Pressed Juice is not suggesting that any individual consumer’s experience with our products is representative of the experience of others. CONDITIONS OF USEING JUICE QUEST’S WEBSITE AND/OR PRODUCT/S:

  • You must place an order with Juice Quest to receive any product or service from us.
  • You may only use the Juice Quest website and/or any Juice Quest product for lawful purposes
  • You do not engage in any improper or indecent behaviour across the Juice Quest website, Juice Quest social media accounts or by using the Juice Quest products in any way;
  • You will not attempt to harass or bully any Juice Quest team member or Juice Quest customers;
  • You may only represent yourself when using the Juice Quest website or ordering Juice Quest products. You may not use aliases, another person’s identity or provide any other false information;
  • All data and content contained on the Juice Quest website and in the Juice Quest products remains the sole property of Juice Quest;
  1. You shall not replicate or attempt to replicate any Juice Quest product or service, including the Juice Quest website;
  2. You shall not use or replicate any Juice Quest products or services for commercial purposes. This includes re-sale of Juice Quest products without the express consent of Juice Quest;
  3. Purchase of any Juice Quest product or service entitles that purchaser the use of that product or service. This entitlement does not extend to any other person. Any purchaser/s must not use Juice Quest products for any commercial purposes.
  • Juice Quest maintain the Juice Quest website for the purpose of running the Juice Quest business. Juice Quest make no guarantees of or take responsibility for:
  1. continuing site availability;
  2. the unavailability of the Juice Quest website or any other ordering system with respect of Juice Quest products that results in any loss;
  • From time to time Juice Quest engage in promotional activities with third parties. Any representations made by these third parties do not constitute representations by Juice Quest and vice versa. By using the Juice Quest website, you consent to information and advertising from these third parties, which may or may not be endorsed by Juice Quest. Juice Quest do not take any responsibility for any loss of damage experienced by you in relation to these third party entities.
  • You indemnify Juice Quest against any loss for any breach of these conditions. Juice Quest will take necessary legal action should we believe any of these conditions have not been met.

FURTHER INFORMATION, LIMITATIONS OF YOUR LIABILITY AND JUICE QUEST’S LIABILITY:
You agree that you use the Juice Quest website at your own risk. You acknowledge that we are not responsible for the conduct or activities of any Juice Quest customer and that we are not liable for such under any circumstances. You are solely responsible for the use of the Juice Quest ordering system, irrespective of who it utilising it on your behalf and/or using your personal information and payment information, whether with or without your permission.

You agree to indemnify us for any loss, damage, cost or expense that we may suffer or incur as a result of or in connection with your use of or conduct in connection with the Site, including any breach by you of these Terms and Conditions (certain rights and remedies may be available under the Competition and Consumer Act 2010 (Cth) or similar legislation of other States or Territories and may not be permitted to be excluded, restricted or modified. Apart from those that cannot be excluded, we and our related entities exclude all conditions and warranties that may be implied by law. To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is restricted, at our option to:

  1. the re-supply of Services or payment of the cost of re-supply of Services; or
  2. the replacement or repair of goods or payment of the cost of replacement or repair.

YOUR PRIVACY
Juice Quest do not share customer data or customer payment details with any other third party without the express consent of that customer.

The Juice Quest website is powered by WooCommerce and the payment gateway is powered by Stripe. Juice Quest encourage all users to familiarise themselves with the respective terms and conditions of these entities.

JUICE QUEST’S DISCLAIMER:
These terms and conditions are not legal advice, nor do they attempt to circumvent any law in the relevant jurisdiction.

Any provision of these Terms and Conditions, which is invalid or unenforceable in any jurisdiction, is, as to that jurisdiction, ineffective to the extent of the invalidity or unenforceability without affecting the remaining provisions of these Terms and Conditions or affecting the validity or enforceability of that provision in any other jurisdiction. The parties will negotiate in good faith to replace any such provision with a provision which is valid and enforceable and consistent with the intention of these Terms and Conditions, so far as is reasonably practicable.

These Terms and Conditions form part of an ecommerce transaction and the parties agree that these Terms and Conditions shall be accepted electronically and the agreement to these Terms and Conditions is formed and validly entered into electronically.

Juice Quest may end the agreement formed by Terms and Conditions immediately by giving you written notice. It is not essential to provide reasons for the termination. Where these Terms and Conditions have been terminated you must immediately cease using the Juice Quest website or services.

Your use of the Juice Quest website may be cancelled at any time, for any reason, by on a temporary or permanent basis. You must immediately cease using the Juice Quest website should you receive a notice cancelling your license to use the Site.

Juice Quest may update these terms and conditions from time to time. Juice Quest strongly recommend reading these terms before placing each and every order.

Billing Terms & Conditions

REFUNDS, CANCELLATIONS, EXCHANGES, RETURNS:
Juice Quest does not provide monetary refunds. All orders are final.
Juice Quest endeavour to deliver the correct products to the correct customer at the correct time, however should Juice Quest make an error, or deliver an inferior quality product, Juice Quest will refund you the total value of the error/inferior product and where practical schedule another pick up to rectify the issue, PROVIDED THAT you advise Juice Quest of such errors no later than 2 hours after receipt of your order;

  1. Juice Quest do not offer refunds for circumstance including but not limited to changes of mind, inability to pick up order, general dislike of the taste/experience of the Juice Quest product, incorrect product selection (by you), incorrect storage of the products (by you) or changes of your plans for the use of/consumption of the product/s or other similar unforeseeable circumstances you may experience. In this instance, Juice Quest may offer you a “store credit” equal to the value of your order to be redeemed at a later date by you or a person you nominate PROVIDED THAT you advise Juice Quest of such changes no later than 48 hours prior to the starting date of your order. Any other person who takes receipt of your order for their own consumption of Juice Quest products is assumed by Juice Quest to have read and understood these Terms and Conditions.
  2. You may wish to swap a Juice Quest product for another Juice Quest product of equal value – Juice Quest are happy to accommodate such requests PROVIDED THAT you advise Juice Quest of such changes no later than 48 hours prior to the starting date of your order;
  3. Juice Quest are providing a fresh raw product and if for any reason you are unhappy, you must notify us by email or telephone within 2 hours of receiving your order. We do not provide monetary refunds, we will provide a new order if we feel reasonable to do so;
  4. If you do not collect your order at the specified time/date we will call and/or SMS your once to arrange a reschedule for pick up. If you are unable to collect and therefore consumer your product/s in the specified best before timeframe Juice Quest take no responsibility for our product. No refunds will be given for late pick ups. We recommend using an esky and ice pack to keep your juice cold whist in transport from our HQ to your home or office fridge (end storage placement of product/s).;
  5. Rescheduling of your order needs to be in writing and given a minimum of 24 hours notice. 
  6. Our juice carries a short shelf life, by purchasing from the Juice Quest website you acknowledge that this is a perishable raw product and must be consumed within the best before date we provide on each juice bottle.
